Terms of Service

By accessing and using the services of Earltech Innovative Solutions Pvt. Ltd. (“Earltech”), you agree to be bound by these Terms of Service. These terms apply to all clients, users, and visitors engaging with our services. If you do not agree with any part of these terms, you must refrain from using our services immediately.

1. Acceptance of Terms

By engaging with Earltech’s services, you acknowledge and agree to comply with these Terms of Service. These terms extend to all clients previously associated with GrowHype.ai, as Earltech has acquired all its assets and service responsibilities.

2. Service Commitment

Earltech is dedicated to delivering innovative website design, IT solutions, and digital services that enhance our clients’ online presence. We prioritize quality, innovation, and client satisfaction.

We reserve the right to refuse service to anyone at any time, particularly if a client violates our policies or engages in unethical practices.

3. Payment Obligations

A minimum upfront payment of 50% of the total project cost is required to commence any project. This amount is non-refundable and covers project planning, resource allocation, and initiation.

The remaining 50% balance must be cleared before the website/application goes live.

For larger projects, milestone-based installment payment plans may be arranged, subject to Earltech’s approval.

Failure to complete payments may result in project suspension or permanent withholding, with no refund eligibility.

4. Revision Policy

Each project includes two (2) complimentary revisions.

Additional revisions beyond this will be chargeable based on complexity.

All revision requests must be submitted within 7 days of delivery. Requests after this period will be treated as new modifications and charged separately.

Major structural/design changes significantly deviating from the original scope will be treated as a new project with a fresh quotation.

5. Client Responsibilities

Clients must provide all required website content (text, images, branding, domain credentials) promptly after project initiation.

The accuracy and legality of supplied content is the client’s sole responsibility. Earltech is not liable for copyright infringements or disputes arising from client-supplied materials.

Clients must remain responsive throughout the project to avoid delays or termination.

6. Ownership & Intellectual Property

Upon full and final payment, ownership of the website’s design and content is transferred to the client.

Proprietary tools, premium plugins, or licensed third-party software remain the intellectual property of Earltech or respective vendors.

Earltech reserves the right to showcase completed projects in its portfolio, marketing materials, and case studies unless restricted by a signed NDA.

7. Hosting & Maintenance (If Applicable)

Clients opting for Earltech hosting services must comply with the agreed hosting plan.

Earltech is not responsible for third-party hosting issues, data breaches, or downtime.

Maintenance, updates, and security patches are not included in the development package unless explicitly stated.

Clients from GrowHype.ai takeover must purchase Earltech’s maintenance services separately under current pricing terms.

8. Termination & Refund Policy

If a client fails to communicate for 7 business days, Earltech may terminate the project with no refunds.

Projects inactive for 30 days due to client inaction will be archived. Reactivation will require an extra fee.

Refunds are strictly prohibited once project work has commenced. Please refer to our Refund Policy for detailed terms.

9. Limitation of Liability

Earltech guarantees functionality at the time of project handover.

We are not liable for future issues caused by CMS updates, third-party plugins, or security breaches.

Post-delivery technical support is available but not included in the base package. It must be purchased under a maintenance plan.

Clients are responsible for ongoing maintenance, backups, and updates, unless subscribed to Earltech’s maintenance services.

10. Dispute Resolution

Clients must first attempt to resolve disputes via direct communication with Earltech.

If unresolved, disputes will be handled under the jurisdiction of Earltech’s registered business location.

11. Modifications to Terms

Earltech reserves the right to modify or update these Terms of Service at any time without prior notice.

Continued use of services after updates implies acceptance of the revised terms.

12. Transition from GrowHype.ai to Earltech

Earltech Innovative Solutions Pvt. Ltd. has acquired all assets, projects, and service obligations of GrowHype.ai.

All past GrowHype clients will now be served under Earltech’s terms, pricing, and policies.

Maintenance and post-project services will only be provided under Earltech’s official maintenance pricing structure.
